Child Safe Policy

1. Purpose

To keep any child or young person (under 18) that KindPath supports, or who is present during KindPath’s work (e.g. in a family/community advocacy context), safe from harm.

2. Legislative and standards basis

  • Child Protection (Working with Children) Act 2012 (NSW).
  • Children and Young Persons (Care and Protection) Act 1998 (NSW) — mandatory reporting.
  • National Principles for Child Safe Organisations.

3. Policy statement

Every worker who may have contact with a child or young person in the course of KindPath’s work holds a current Working With Children Check (WWCC) before that contact occurs. This applies whether the young person is a direct participant or present incidentally (e.g. a family member’s child in a household KindPath is supporting).

4. Procedure

  1. WWCC status is confirmed and recorded for any worker whose role may involve contact with a person under 18, tracked alongside NDIS Worker Screening in the Human Resource Management Policy.
  2. Workers are trained to recognise signs of harm and understand mandatory reporting obligations under the Children and Young Persons (Care and Protection) Act 1998 — a reasonable suspicion of risk of significant harm to a child is reported to the NSW Child Protection Helpline (132 111), not investigated informally by the worker.
  3. Any concern about a child’s safety, including one raised by the child themselves, is treated with the same immediacy as an adult safeguarding concern under the Safeguarding Policy.
  4. If KindPath does not currently support any participant under 18, this policy remains in force as a readiness standard — WWCC and training requirements apply from the point KindPath first has any contact with a young person, not retrospectively once a gap is noticed.

5. Roles and responsibilities

  • Director: confirms WWCC status before any worker has contact with a young person; is the mandatory reporting escalation point.
  • Workers: report any concern immediately; understand they are a mandatory reporter under NSW law in a professional capacity.
