NDIS Code of Conduct Policy

1. Purpose
To adopt and apply the NDIS Code of Conduct, which binds KindPath and everyone providing supports on its behalf regardless of registration status.
2. Legislative and standards basis
National Disability Insurance Scheme Act 2013 (Cth), s.73V; NDIS Code of Conduct (NDIS Commission).
3. The Code (as applied at KindPath)
Everyone delivering support for KindPath must: 1. Act with respect for individual rights to freedom of expression, self-determination and decision-making. 2. Respect the privacy of people with disability. 3. Provide supports and services in a safe and competent manner, with care and skill. 4. Act with integrity, honesty and transparency. 5. Promptly take steps to raise and act on concerns about matters that might have an impact on the quality and safety of supports. 6. Take all reasonable steps to prevent and respond to all forms of violence, exploitation, neglect and abuse. 7. Take all reasonable steps to prevent and respond to sexual misconduct.
4. How this is applied at KindPath specifically
- Point 5 (raising concerns) is what the Safeguarding Policy, Feedback and Complaints Management Policy, and Incident Management Policy operationalise — a worker is expected to raise a concern the moment they notice it, including about their own or a colleague’s practice.
- Point 7 (sexual misconduct) is addressed in detail in the Sexual Harassment and Bullying Prevention Policy, which also covers the reverse direction — a participant’s conduct toward a worker — since the Code’s protective intent runs both ways in a genuinely safe support relationship.
- Every worker signs an acknowledgement of the Code at induction, alongside the Staff and Volunteer Code of Conduct (KindPath’s internal behavioural expectations, which go further than the NDIS Code’s minimum).
5. Breach
A suspected breach of the Code by any worker is treated as a safeguarding matter under the Safeguarding Policy, and — once KindPath is registered — may itself be something the NDIS Commission needs to be made aware of. Breaches are not managed by informal conversation alone where they involve participant safety.
